LAMTEC METAL BUILDING VAPOR RETARDER LIMITED PRODUCT WARRANTY

IN ADDITION TO LAMTEC’S STANDARD TERMS AND CONDITIONS, THE FOLLOWING LIMITED WARRANTY APPLIES ONLY TO LAMTEC VAPOR RETARDERS DESIGNED AND SOLD FOR INCLUSION IN CONSTRUCTION OF METAL BUILDINGS. 

 

Who is Covered

 

This warranty is granted to the original building owner where the product is installed. 

The warranty may not be transferred except in the case of the sale of any building in which the product is installed, in which event the warranty shall transfer to the new building owner.

 

How Long Are You Covered

 

Lamtec Corporation warrants that the facing material is free of manufacturing defects for a period of 10 years from date of shipment from the factory, subject to those Terms, Conditions, Limitations listed below.

 

Claims Process

 

Claims must be submitted within thirty (30) days after detection of the defect, by means of a letter sent certified mail, return receipt requested, setting forth the nature of the defect and the date of its discovery.  The letter is to be sent to Lamtec Corporation, 5010 River Road, Mt. Bethel, PA 18343, USA; addressed to the President.  By so notifying Lamtec Corporation, the Owner authorizes Lamtec Corporation, or its designee, to investigate the defect and agrees to give Lamtec Corporation access to its facility during normal business hours and to cooperate with the investigation.

 

Terms, Conditions, Limitations

 

If, after investigation by or on behalf of Lamtec Corporation, Lamtec Corporation determines that there is a manufacturing defect in the facing material, Lamtec Corporation shall, in its sole and absolute discretion, either repair the defect or provide replacement material for the specific areas affected.

                                                                            

Lamtec Corporation’s sole liability for any manufacturing defect in the facing shall be limited to the cost of repair or replacement material not to exceed the original Lamtec invoice value of the facing materials adjusted as follows:

 

In no event shall Lamtec Corporation be liable for special, indirect, incidental, punitive or consequential damages.

                                                                                                                                             

In the following cases, among others, no claim may be made on the basis of this warranty:

• the facing material is not installed in accordance with applicable industry guidelines such as those      published by NAIMA (North American Insulation Manufacturers Association), NIA (National Insulation Association) or the manufacturer of the building

• the facing material is damaged through shipment, improper storage or abuse, whether deliberate or  otherwise the facing material is utilized in a manner which exceeds the design limits of its physical properties

•  the facing material is stained or otherwise damaged from foreign substances (e.g. oil, diesel exhaust, caustic or acid atmosphere, paint, etc.), environmental conditions (e.g. excessive heat, humidity, moisture, mold, etc.), or abuse

• the damages have arisen due to, or in connection with, causes which were not foreseeable at the time of commencement of the project

• the improper design of the building or construction pursuant to applicable building codes.

• the facing material is not utilized for its intended purpose as a vapor retarder for a metal building.

This warranty shall be null and void if repairs or modifications have been made to the facing material without prior written approval from Lamtec Corporation.

 

LAMTEC CORPORATION MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE FACING MATERIAL.
